    f1 student 5 years federal tax form and medicare and ssn refund?
    Hi

    I came to US (from India) on a F-1 Visa on Dec. 23, 2005.
    I am currently on OPT which started in Aug. 2010.

    The questions I have are :
    1) Is this my 5th year or 6th year as a F1 student?
    2) What form do I use for federal return 1040 or 1040NR?
    3) Currently my employer is with holding FICA (medicare and SSN), (from Aug. 2010). Am I eligible to ask for a refund for 2010 taxes?

    You are in your 6th year in 2010 (it goes by calendar years), so you are a resident alien for 2010 and are subject to social security and medicare taxes. As a resident alien you file form 1040 (or 1040A, 1040EZ)
