Asking on behalf of a family member in a different state who's laws I know nothing about..

My brother and his wife want to divorice.. (of course they say this every other month), anyway, they have a young son. How does the father(my brother) go about preventing her from leaving the state with their child with out his permission? They have not filed for divorice (and Im not sure they know how to) She has family 10 hours away from his military base, and will probably try to move. Does he need to file for legal separation first? Do they both need to be present to do this? He needs to have something on recond asap to keep her from leaving the state. :( He loves his son with all of his heart, and she used that against him. Also, Will they need to file through their current county residence or will the military have some play in this also?

ANY question on law needs to include your general locale as laws vary by area.

He does need to file immediately. Once there is pending litigation then even if she does move he may be able to bring her back. He should consult a local attorney immediately.

secondly the powers that be have to allow a relative to be it's guardian.
if the child welfare people don't want you as guardian they will give it to
someone like that couple in Florida instead of letting the aunt and uncle have custody,
the people in Florida killed the children the social workers would not let the birth
uncle and aunt take care of and adopt. So the children will die, in a strangers home.

but if instead things go well, then perhaps with luck, and God's help you may get the little ones
into a truly safe environment with a relative, but expect a fight every step of the way.
because the child welfare people use a field of science that has beem disproved completely, I will
give you a hint, it starts with psy . You see the government thinks random stranger are better than
relatives, that is how sicj they are. They have everything backward, since as romans 1 says, quote
they have made their brain useless by choosing to forget that God exists, unquote.

Where did you get all that garbage from? You are making so many assumptions that have no bearing on the question asked. I don't see any issue of guardianship or the authorities wanting to place the child with anyone else but a parent.

The question was simply about how to prevent the mother from moving out of state. You have been told before to spend more time reading the question before posting an answer.

Your post isn't relevant to the OP's question. The only thing you said correctly was that about the advice through the military. The op is seeking advice on behalf of someone not for himself to gain custody.

Califdadof3, I am not sure he even got that correct, I believe they are cutting back and while they may give some general advice, they may still have to hire their own attorney anyway
