    Whenshould a executor file a will ?
    My father died 5 weeks ago and my sister whom says she is the executor refuses to file or read the will. Is that legal ?

    Yes, probably. I don't know what state you are in, but I am not aware of a statute anywhere requiring that a probate case be filed that early.

    A "reading of the will" is a dramatic invention by-the-way. There is no requirement for such a ceremony in real life. Ask her for a copy and, if she doesn't comply, consult an attorney.
