    If I am not in US for over 188 days ( non-resident ) can I apply for a joint tax return as my wife as a dependent?

    asa non-resident alien you cannot file a joint return.

    Nonresidents file Form 1040NR or 1040NR-EZ. You can not file it as joint return.
