    Spouse chose to file married separately
    I was married for 12 months in 2010. Currently I am in the middle of a divorce. My spouse had her accountant file married separate and as a result put me in a very bad tax liability with no interest, children and other credits afforded a joint filing. I own my own business as well so more taxes. Overall I have to pay $8000 more than I would have on a joint return just because she wanted a refund of $3500. I even offered the spouse to pay what her refund would have been and that would have saved me $5000. I even offered to use the difference to pay on some joint debt we have.

    So my question is, can I sue spouse for the lost money? Her only motive for this was to stick it to me and this is documented in emails from her.

    Hello Z:

    You ARE suing her. That's what divorce is - a lawsuit. You CERTAINLY can bring up her bad behavior to the judge. He'll probably make some adjustments.. You DO have a lawyer, don't you?

    Sure do have a lawyer. Just did not know if this could be part of any spousal support claim or if it needed to be separate action.
