Are they under legal age ?
Are they not mentally competent ? ( since this is under mental health)
Are you in some position of power or authority over them ?

As Chuck said, and is this YOU you are asking about(being touched,or doing the touching?)

There has been too much in the news about things like this, too much drama made over kindness and friendliness,I hope you aren't making too much of that.

Well as Chuck said.. what is that person's mental state?? Is that person being pressured into saying yes?? Both of persons should be in total agreement before any touching is done!
