    Can USA citizen be written single on his tax paperes if he is married to a non citize
    My husband is a USA citizen and he is written single on his tax paperes. I ve never been in USA and I don't ve SSN. We are waiting to get a spouse visa for me so I can immigrate to USA. Was it possible for him to be written married instead of single while he s married to a non citizen. Thank you

    As he is married, he must mark that he is married. It does not matter that you do not have a SSN, millions of people do not. If he marks single, this will complicate your IV. Consult with an immigration lawyer experienced in IV CP.

    His filing status must be "married". He can submit W-7 to apply for ITIN since you don't have SSN, submit W-7 together with 1040.
