    Small claims at show cause defendant claims he will file bancruptcy
    At the show cause hearing, the defendant claimed they will be filing bankruptcy. The magistrate just said OK and scheduled another court appearance. Why did the magistrate not pressure a payment plan as bankruptcy has not yet been filed? Also, justice in America yet again... let me guess, we will never see any money and the criminal skates! What a system!!

    This is more of a rant and/or discussion than legal question.

    What was done is not unusual OR illegal. Why go through all the paperwork if the Defendant is going to file Bankruptcy and it will be erased anyway? Not uncommon to grant a stay for X number of days. If the Defendant has not filed by the end of that time, then the Judge will move the case forward.

    I think ALL of your questions about this case should be combined.

    ready1 does not find this helpful : How can one combine if this goes on over months and months and new questions arise after each court appearance? This may be old hat to you and others but a first for us. Isn't the purpose of this forum to ask for help and ideas. Yes, many new victims


    I don't make up the rules here - it is IMPORTANT to read the history of your other posts in order to answer THIS question. History is important when it comes to legal matters.

    I answered your question. I did NOT address your comments/rant and still believe this is a subject for a discussion board.

    As far as describing debtors as criminals - you are very much off base. Debtors, even if they don't or can't pay, are NOT criminals. Debtor's prison is no longer used.

    You combine it by adding your new question to your old question so the history is in proper sequence.

    Well, I am ON base as this person has a criminal record due to their actions which caused these debts. So do not paint everything with your brush as you may be OFF base. So long and thanks again for your diatribe answering my rant!
