    Good day all,

    I need your assistance. I am a 70 year old man whose wife has just passed away 2 weeks ago. I am in need of information regarding the house we lived in for over 22 years. (also married 22 years) I would like to know if I have some type of legal rights to this house. I have made the mortgage payments every month, however my name was not on the deed. My deceased wife's children are trying to consume the home. Please help. Sincerely, Carlton.

    Was your name on this home also, or was it Just your wife's? If your name is also on the deed the house is also yours, if not the children Do have the right to the house. Good Luck!

    Did your wife have a will? If so, did it address what would be done with the house?

    If your wife did not have a will then you probably have a legal claim to the house, or a portion of it, depending on your local probate laws. I suggest that you see an estate attorney as soon as possible.

    What are the laws in the state in which you live? Your state bar association will have a lawyer referral process wherein they can refer you to an attorney (who has no complaints against him/her) and that person can tell you exactly.

    If your State is a Community state like it is here in Pennsylvania, then the house should automatically go to you, the spouse. Seek the advice of an Attorney.
