At what age can a child decide where he wants to live and whome he/she lives with
My nephew has lived with my cousin all his life and now his birth mother is trying to get coustody of him. He will be 14 in less than a month, how old does he have to be before he can choose who he lives with?
18.
Until then, the courts decide what is in a child's best interest.
At 18, an adult can choose where he or she wishes to live.
A child cannot decide. Only a court can. Depending on where he lives the court may give more or less weight to his preference.
Many courts will allow a child 12 to 14 to testify as to where they may like to live, but that does not decide, the parents still present evidence as to where it is best to live.
The judge will review where they have lived , how long and how the chiange may effect child.
It is not till they are 18 that they can decide on their own
