    Adoption for stepson with bilogical father's surname
    I have a 13month old son. I had used my Ex's surname but we didn't seem to work out. I have been married and planning to change my son's surname to that of my husband. Do I need the consent of the biological father since since surname was used? Thanks

    YOu need the consent of the biological father REGARDLESS.

    No adoption can take place without the consent of BOTH legal parents, and in this case one of those legal parents is your ex.

    She isn't asking about adoption, but rather change-of-name.

    But the consent of the father probably is also required to change a minor's name. What state are you in.

    Sorry, I moved the thread from the adoption boards and forgot to note it--which is why I assumed she was asking about adoption.

    I should have noted it, but you're right--the clarification between name change and adoption is needed as well.
