Husband on H1 and wife on H4 filing her return for first time
Hi, My husband resides in US since 2006 (F1) and file 1040NR- EZ, I moved with him in this Feb (H4 Visa). His H1 Visa started from Jan 2011.

My question is, when to apply for ITIN? As per rule united state federal tax return needs to be attached with W7 form, which I don have .

Also if we file our income tax return jointly or separately, how much standard deduction we can claim?

    Thanks

For 2006, he will file nonresident tax return.
For 2011 he will file resident tax return. You can file joint return. Attach W-7 with your 2011 tax return.

    Smitha5:

You did not specify WHEN you got married nor did you identify your home country.

If you are from India and you were married before 2011, your husband MAY be able to claim you as a dependent on his non-resident returns.

If you email me the specifics at [email protected] or [email protected], I can give you concise guidance.
