Ok, so when my ex and I split we got a court order for him to see our son, this is every 2 weeks for the Saturday thought till Sunday at 4pm, the problem I have is he drinks an awful lots and is abusive to me via phone and text, so I have now got a mobile phone for out son so he can just talk to him, he now is sending text messages on our sons phone when he is drunk, I really am worried about our son spending the night with him... this isn't just a 1 off, it has been an ongoing thing I have even had to get the police involved about the abusive text's... any help would be great

How drunk does your ex get? Does he drive when he is drinking?

You need to go back to court with proof of his drunkenness and ask that his visits be restricted or supervised.

He will be 10 in August
Very.. To the point that he does not remember what he has said from when he is drunk.. He has now lost his driving license 3 times due to drink driving

So the fact that the son is only 10, combined with the fact that the father gets inebriated to the point of memory loss, suggests that he is (when he gets drunk) in no shape to take care of the son.

Yes, I'm not suggesting that he is not allowed to see our son if he is sobor,but if he is in not fit state I'm worried that something may happen to out son, i.e. he smokes- what if he falls asleep when smoking and drunk, I dare not think what could happen

So you cite his record and ask for supervisied visitation. But you still have to do this in court.
