I make payments on a used car that I got in June 2010 and still haven't gotten the registration. I found out the dealer just got the title feb. 2011. Is that payment contract now void and can I give the car back and get my money back?

Besides, this is not a real estate question.

Registration is your problem... not the dealers. THey will have a lean on the title until the loan is fully repaid. That's how they can repossess it if you default.

It sounds like there is more information that you haven't told us.

Who holds the title has nothing to do with your contract.

It's a crime to drive without registration. I don't know why the dealer doesn't know that, but it's not HIS driving record at stake. It's YOURS. You should have known that. If you didn't get a ticket for it, you're lucky.

You CAN report them to the bureau who regulates car dealers in your state or city. Plus, I'd go to the dealership and tell them that you're not leaving WITHOUT a registration. If they don't give you one, I'd leave the car.

Wonder if this is one of those buy here/pay here deals? This does happen in NY. Title does not transfer so registration does not transfer until vehicle is paid for. Insurance is included in vehicle payment.

Yes buy here pay here! Insurance is not included I pay own insurance. He never had title until now. Seems like none of these answers were an actual answer.

THe reality is your statements don't jive with reality in the USA...

THe Dealer never registers the car for you, they may act as an agent with the state to handle the registration application, (PA is like that) but they don't register it... YOU do. You don't get clear title until they have received full payment.

I've owned over 14 cars and trucks and 6 motorcycles in 3 states and two countries the last 32 years. All in my name... and I now have vehicles registered in two countries.. current and legal.

I have more than an idea how these things work.

Buy here/pay here - IN NY - is different. You do not get the title and registration unless/until the vehicle is paid in full. The "dealership" gets around the law by keeping the vehicle in name of dealership, insuring in name of ownership, "charging" back the insurance premium.

Only know this because of the accidents involving buy here/buy here that I've investigated.

Oh I bet That's expensive to cover their butt in the likely and potiential (given the people who would buy there's) liability issues... most of who's driving records likely aren't better than their credit history.

And you are right - once again.

OP needs to take a closer look at her "purchase contract." This very well might be a glorified rental (as we call it in "the business").

I've bought a few cars myself. Every time I bought one from a dealer, he gave me a TEMPORARY REGISTRATION so I could drive the car legally. I don't know how they do it in your neck of the woods, but I cannot imagine it being much different. I mean, you have to have SOMETHING to show to a cop if he stops you a block away from the dealership.

I gather that the OP didn't even receive that. Nope. She DIDN'T. I stand by my advice.

Registration and title are different things. It does not void your contract in any way that you haven't received the title or the dealer didn't have it.

I gather you don't like the car and want out, but this won't do it for you.
