I have a 5 year old son and my sons father has not done anything for him in 4 years. He signed his birth certificate. He is in and out of jail for domestic violence and drug offenses. My mother has played the father role. I don't have a child support case on him because I feel its not worth it he has 7 other kids, and owes well over 80,000 in child support, he willnever work, because of that and my child willnever get anything. He harasses me, threaten to take my son away, threaten my mother, used my address without my permission and gets mad cause I will not have sex with him. I just want his rights gone and my sanity back. I don't want anything from him!

You can't have his rights terminated if he is the bio father. He has to agree to sign off. You can however get a restraining order against him.

Well this is a borderline case. There are basically two reasons where the court will grant a TPR. One is to clear the way for an adoption, the other is when the father represents a danger to the child.

With a criminal record for domestic violence and drug abuse, you MAY be able to get his rights taken away as a danger to the child. But frankly, that will probably not accomplish much. I assume he does not have any visitation rights at this point. Have you tried getting a Restraining order against him to keep him away from you and your child? That seems to be more what you want. Once you get the RO, he may fade from the picture. But the only reason to get a TPR would be to prevent him getting custody or visitation.

I do want to point out that you had to have known about at least SOME of the kids when you were sleeping with him. While the domestic violence and drug offenses may have only happened AFTER you split---I doubt it somehow.

So... YOU slept with this guy and had his baby. That puts a little bit of it back on you--what is YOUR judgment like if you were willing to take the risk of pregnancy with him?

There are VERY good reasons that TPRs don't happen just because someone says "that parent is a bad parent! take away their rights!". If that were all someone had to do, well, I could make a case that YOU are a bad parent and take away YOUR rights--based on that poor judgment thing. Doesn't sound so good when it's turned around, does it?

TPRs are only given to clear the way for an adoption or when the parent presents a definite danger to the child. Of course, you must have documentation of the danger to the child for this to happen.

I suggest you start with a restraining order and go after child support. Support and visitation have nothing to do with one another, and the father NOT paying support is one more reason you take with you when you've gathered all of your proof.

In response to Synnen, I knew about 2 of his kids, and I don't believe in abortion!! Regardless yes I was young but that does not make me a bad parent! Like I stated I don't want anything from Him! I can take care of my child! This is my 2nd PPO, he has been to jail twice for violating it, tired of going to the court getting them after they expire. And what I meant about using my address is he put my mother address on his drivers licsense. Went to DMV and they told us that a person does not need proof! Then went to the court they said we had to evict him, when he never even stayed the night at this address. Send him papers to where, no address for him! I only have his phone #. He stay from one place to another! Thanks ScottGem & Tickle! **** the rest of you, why response with dumb ****!

DMV , I had to take in a electric bill or something just to get my own address changed to a house I own. so somehow but so what that he puts his address as yours, it does not matter, so you get a few letters to your address, throw them in the trash.

He can only harass you if you talk to him, so don't, if you have a protective order he can talk to you either.

If you can prove he is a danger to the kids, not just a bother to you, you can try and take his rights away but it will be a harder battle and you will need an attorney
