Do I have to pay my child's healthcare if she is a canadian citizen?
I just applied for healthcare for myself through my employer and my employer told me he got an order telling him that I have to insure my child as well.. however.. my child is a Canadian citizen and has universal health care.. which means she's covered already. I talked to child support services and they told me to file a motion in court to have my original ordered altered. Will a judge grant me this? And what other prof do I need because it is already on File that she was born there and by being born there she has the right to health insurance there.. and she has used it. Can't wait to get an answer for this.. and thank you..

I assume you are a US citizen living in the USA, and the mother and child are in Canada. Correct?

Yes. I am an American citizen I have no arrears, my child is 17 and was born there and has lived in canada her whole life.

The mother and child live together in canada and are both canadian citizens too.

Yes, you will have to go to court and get the current order modified. If the mother of the child will sign and agree to the motion there should be little problem

THank you! One more question. According to the state of California I am all paid up with child support. I still pay on time and the state looks at me as a good payer. However according to the government of Canada because of the exchange rate it turns out according to them I owe them a balance and that the balance has been going to the thousands of dollars. In other words The U.S. tells me I'm Upstanding, but Canada says I'm a dead beat dad. So once my daughter turns 18 will canada be after me? And can they touch me here in the u.s. And if I try to go visit canada will they arrest me at the border, put me in the hole, and torture me for the money?.

Where did your support order originate from? Canada or California? Im guessing by the question it is Canada. If that is the case then yes you could owe arrears. Since exchange rates vary widely sometimes and the American dollar has been tanking its up to you to make up the difference.

On file? As in the California child support court case file? It may be that the file will show your daughter was born in Canada, but I doubt that it shows everything the judge will want to know about universal health care in Canada. Rule of thumb: assume the judge knows nothing except what's attached to your motion. If you want to reference anything else be sure to cite to that portion of the record in which it can be found.
