    Hi there
    I was on an e3 visa in USA for sept until dec 2010 under 183 days, and am an Australian! Am I exempt from ss and Medicare taxes in Oregon have already had them deducted from my pay(appear on my w2 form) and which forms do I file for a refund(1040nr ez) didn't include ss and Medicare refunds? Also I am single with no dependent, have left USA; non resident

    Even though you will file as a non-resident alien, filing Form 1040NR and Form 2106 to claim daily living expenses, you are NOT exempt from FICA (Social Security and Medicare) taxes, because you were working under a WORK visa.

    You should get credit for the FICA taxes paid in your home country equivalent tax account under the totalization agreement between the U.S. and Australia.
