    If there is no court order that awards him custody and visitation you are not legally required allow him visitation or allow your daughter to visit him.

    However, unless there is a compelling reason not to allow, like he could be a danger to her, then he can go to court and get visitation. In court the judge will look at the fact that you have refused visitation and may be prejudiced against you because of it.

    If you explain why you don't want them to visit (and how old your daughter is) we can advise further.

    As Scott said, we need more info.

    I WILL add that I would NOT allow the father to take the child out of my sight without a Court Order. If he takes her and doesn't bring her back and there is no Court Order you COULD have a fight on your hands.

    Is the father on the birth certificate or is there a court record of his paternity ?

    Is there court action in court pending ?

    I am going through the same thing right now. I am afraid of my daughters father. One minute he's civil with me and the next he is threatening to find a way to get my kids taken away from me. Our child is the youngest. I am just in fear that he will take off with her. I don't know what he's thinking from one minute to the next anymore. SInce we split he is becoming more and more unstable. Is this a good enough reason to keep her from him and not have it get me in trouble?
