    30 day notice
    We had a lease that expired on June 30 of 2006. We then went to month to month agreement. So now we want to move and gave a 30 day notice on the 12th of jan. 07 and our landlord is saying we have to give the 30 days at the beginning of the month. Is she wrong or right. We live in Wisconsin. We told her we would be out on the 10th of feb. 07 and we would pay the prorated amount. And she says we are responsible for the full month of February. Is this right?

    Your landlord is right. Some leases word it exactly that way so there's no misunderstanding, and some don't.

    I see that you understand the technical details of your position, but you fail to see the practical side of it. Most people want to rent at the beginning of the month. The law and most leases are geared to that preference. So, if you vacate in the middle of the month, your landlord is going to lose rent.

    That's why it's not only a requirement that you give your notice on the first, it's the fair thing to do too.
