    Need Advice Bad!!
    I am being sued over a credit card debt. I was enrolled in a debt settlement program, and this is the only one left. I went to my first court date. Couldn't get any where with them. So we made a second court date. I ended up getting sick and missed the second date. They got a judgement against me. I was waiting to get something about the judgement, didn't get any thing. Finally I got something from my credit union. It was a citation to discover assets. With a return date of 2-15-11. They froze my savings double what they are going for. My savings is from a workers comp. settlement. I don't work I am on disability. Can they take my money ? Should I go to the court date? Should I try to file a motion to vacate? Just so confused. Also I should add that its in Illinois.

    They can take your savings... you would have to be able to definatively prove they came from an untouchible source. SSI Disability is a hands off source... I don't think Workmans comp is however.

    As far as going to court... you missed that chance when you didn't show up and never got a continuance... so they already ruled, in the favor of the debtor.

    You aren't going to get a motion to vacate a judgement in a case you lost because failed to show up for the court date past any judge, unless you have no family or friends and wasn't in Intensive care or in a coma.

    There will be other answers... so be patient.

    True... I was hoping someone else whould chime in... usually they do, sometimes they don't.

    You have no grounds for a motion to vacate. I don't see another court date, I just see an order for discovery that you have to return by Tuesday.
