Can I file jointly when I am filin for taxes if my wife has a B1/B2 visa?
I am a US Citizen and have been married for the last 8 months. My wife is here and we are in the process of adjusting her status through I485. She is not a resident yet and I would like to find out if this may be a problem if I file for taxes jointly.

    Thank you for your responses.

Yes, you can file jointly with your wife. She does not even have to be in the United States.

You will have to submit Form W-7 to get her an ITIN, but that process is done with the tax return and delays the refund by about a month over filing electronically.

If you need professional help filing your return and applying for the ITIN, email me at [email protected].
