You don't have the legal standing to do anything... he has to do it. And the INS is who decides if they can be fixed or not.

As a USC, you can petition for your husband. You need to provide much more information for this forum to determine if he is eligible to file for permanent residence here in the US or if he needs to return to his home country to apply for the immigrant visa (IV) with a waiver.

Where is he from originally? When did he enter the US? Did he use his own passport and visa to enter the US? Did anyone or any business file anything for him prior to April 30, 2001? Does he have any other USC relatives? Does he have any arrests, charges or convictions? Has he ever been deported before? Does he have any other immigration violations?
