    Itin rejected for 2009 tax season
    I am a US Citizen married to a non-resident Canadian citizen. We filed for an ITIN number for him last year (2009 tax season)so we could file married joint; however, the ITIN number was rejected. The IRS then adjusted the return to remove him as a dependent (allowance)and processed my return. Do I need to file for an ITIN again this year? Or is there another way to file my taxes this year than apply for the ITIN again? Also, how do I claim 1099 income for him from 2009 & 2010?

    Spouse is never a dependent. You can file joint return. Attach W-7 with your tax return. Do not file it separately. On joint return both must report worldwide income for the year.

    Would this apply also if one spouse is a J1 visa holder physician and other is a B1/B2 visa holder currently in US since 3 months?

    We got married in Oct 2010.
