    Laws about refiling charges?
    If I went to trial and witnesses didn't show up, so the case got dismissed, how long does the prosecuter have to refile charges

    It helps to know what type of case and what state this is... as some laws and Statutes will vary state to state.

    Till the SOL for that level of crime, in that state runs out.

    Statute of Limitations. Look at it as an experation date they have to proceed before.

    Has your attorney considered whether the Double Jeopardy Clause allows a retrial under these circumstances? Was the dismissal upon motion by the prosecution or the defense?
