    H1B visa Tax filing status
    Hi, Ihave a question regarding the Tax Filing Status. I am on H1B, came to US for first time in Dec 10. I am married and my wife is in India. I am living alone here. Can I put my marital status Married or Single while filing the return?

    You need to file as a non-resident alien, filing Form 1040NR or 1040NR-EZ.

    Given that your income is for less than one month, it is likely that the $3,650 personal exemption will completely offset your U.S.-sourced income and you will owe ZERO taxes.
