She states that she is giving me a 1099 instead of a w2 I am thinking because she didn't send any taxes in thru-out the year. What do I do?

I'm assuming that she withheld taxes from each paycheck?
Let her know that is highly illegal and very serious, that you will report her to the Dept of Labor and file a return to the IRS and state anyway, and that she has until the end of today to cough up that W2.

1099 income costs YOU a lot more, even if she refunded every penny she withheld. Totally unfair, wrong, and illegal.
