    Landlord making you pay past rent
    My landlord is going through our files from 2008 for rent payment history. They are saying a couple of tenants did not pay rent for several months that year. Are they allowed to make you repay rent from back then. I can only find some of my money order receipts for that year. What can I do about this?

    If they can PROVE you did not pat rent at a particular time then they can go after you. Can you PROVE you did pay the rent? What exactly are they saying to you? They have to show what month was not paid. Sounds like a bunch od schlocks doing even more schlocky paperwork. If a tenant did not pay in March 2008 I'd be on it by March 10th 2008.

    I'd refuse to pay... If he didn't catch the mistake when it was made, he cannot now go back to correct it.

    This falls under the legal notion of Laches. By invoking laches, you are asserting that an opposing party has "slept on his rights," and that, as a result of this delay, he's no longer entitled to his original claim. Put another way, failure to assert one's rights in a timely manner can result in a claim being barred by laches.
