How to get SSN or ITIN overseas?
I am in USA since Aug, 09 and considered resident-alien now for tax purposes.
My wife was in usa in 2010 for 35 days under L-2 visa( as my spouse, and I am on L-1).
Currently she resides in her home country( she is non-resident alien in USA) due to her contract obligations. While she's was in USA, we did not apply for SSN, and now since there is a significant difference in tax return I would like to file tax return jointly.
I called IRS, they said since she was on L-2 status, she is eligible for SSN. So, they will reject ITIN applications without Denial Letter from SSA.
SSA requires a valid visa from her and her presence in the country. Her visa was valid only for 1 month, while I-94 was for 3 years. There is no I-94 now, only expired L-2 visa, technically she is not eligible for SSN anymore, but how to get that Denial Letter now.
Please help.
