    Why I have to pay FICA-OASDI tax as I am a temporary worker?
    Hi,

    One basic question, why I have to pay FICA-OASDI tax when I am a temporary worker against H1B visa type and ultimately I have go back to my country,then what is the logic to deduct the tax from my paycheck?

    When I am not going to avail the facility and then also I have to pay the amount... I could not understand the logic of it.

    Is there any way to get back this amount?

    Anyway out..!

    People pay into the system and die. No logic there, either.

    You will be filing US tax returns, right?

    Yes, there is a logic. You have work visa and after couple of years you may get green card.
    If you do not pay FICA taxes while on H1-B, it will be unfair to U.S. citizen and residents who pay FICA taxes starting from first pay check.

    Hi,

    If some one will not stay in this country then what will happen to this amount? One more thing this tax will not work for high
    Paid worker.. right?

    Could you please let me know what are the criteria to get green card from H1b visa and what is the procedure?

    The highest paid workers are not giving this tax, so the purpose of this tax is for social security in future.. right? Do you feel that I person who is temp worker not highest paid.. contributing a amountfor his future security & will not get that back

    I'm confused - either you're going "back" OR you're trying to get a green card. Before I spend a lot of time on this, which is it?

    All things considered, there is NO fairness involved with requiring workers who, by virtue of the work visa program, will probably NOT work long enough to qualify for Social Security and Medicare benefits to pay into the system.

    That said, NO ONE EVER said taxes were fair! It does not change the fact that it IS the law.

    Further, for many countries who have identified this basic unfairness, they have entered into totalization agreements with the United States, which transfers the funds for the Social Security portion that the temporary worker pays into the similar fund in his home country. You can find a list of such countries in IRS Pub 519.

    Som (the OP) should check to see if his home country participates in that totalization agreement.
