    Hello jd:

    You'll have to explain further... A "default" sounds like a judgment has already been entered against him, so it's too late for a trial...

    Yes if you are in civil court and was sued, a default is given if you did not respond to a notice or did not show up for court.

    So if that has happened, you will have to find a grounds for an appeal to have the case opened back up.

    Better to move to set aside the default. Else there would probably be no grounds for an appeal.
