    Can a landlord bill me for back taxes in month to month commercial lease
    My 3 year commercial lease expired and landlord put me on a month to month, although I was paying higher rent I agreed to avoid lease commitments, now he wants me to pay back taxes and operating expenses of over $1000 dollars.

    Can he do that or monthly rent is what I should be obligated for

    Keep in mind if push comes to shove... on a month to month lease... he can terminate it with 30 days notice and where does that leave you.

    You need to check the terms of the lease to see if you was obligated to pay those or not... in case he is coming after you to pay something you didn't over that period.

    Exactly what State and or Country is this in... Laws vary.

    Also I do not an actual monthly lease agreement with the landlord at all

    Hello G:

    I don't know what you agreed to, so I couldn't say what's right.. I DO know that what's WRITTEN down will be what the judge will go by, and you have NOTHING written down.

    Residential landlord/tenant law says that an existing lease converts into a month to month with the SAME terms and conditions when the tenancy ends... There's NO such provision in contract law, which is what COMMERCIAL landlord/tenant law is based on. Unless your lease specifically mentions what the terms are on your extended stay, you have NOTHING written down.

    Since there's NOTHING written down in your case, he's going to have an awfully hard time proving that you owe it.

    The terms of the original lease is valid and standing, except that they are allowed with notice to raise rents and evict and you can move out with the notice listed in the lease.

    When you leave a lease and merely pay on a moth to month, the lease terms except for length and amount all stay valid.

    So again, go back to the old lease, if you were obligated to pay those then, you are still obligated to pay.
