Are you married, are you on the birth certificate is there an acceptance of paternity ?
Is there a court ordered child support

Merely having the same last name, does not prove anything on its own merit, how does the child have that name

His ex girlfriend is claiming he is the father but the thing is this child is his ex' mother they
Felt bad for her so on the day of birth angel which is my bofriend now put his lastname on certificate, so its not his or his ex child but its her mother with his lastname

Signing the birth certificate may have been an acknowledgment of paternity. Depends on local laws (ANY question on law needs to include your general locale as laws vary by area). If it is, then he could be held liable for support.
