    No car insurance in Indiana
My daughter was driving my car she is 17 I had no car insurance and the accident was clearly not her faulty according to police, I live in Indiana her car was totaled and I don't care about the car, but is there anything I can do if he has or does not have insurance himself

Funny thing Karma... you didn't have insurance and it would be funny if they didn't either.

Expect the issue to come up... I know I would be raising holy hell if the other party didn't have it, if I was at fault or not.

Yeah you can file if they have it... but if they don't you have to collect from your own uninsured motorist rider of the policy you don't have.

Take them to court... and its likely to be used against you on any settlement.

I don't know if they have insurance or not, I am so upset I should have never trusted someone else was paying my insurance

I'm surprised the State of Indiana didn't come after the plates. If the lapse time wasn't long... you might get it reinstated by paying the past due amount and covering your butt so to say. Not just here... but I know Virginia will hit you with a big fine for lapsed insurance.

Why don't you know whether the other person has insurance? Your daughter should have collected the ID and insurance information from the other driver at the time of the accident. Then you call the other person's insurance company and file a claim for your loss. If it turns out that the other driver had no insurance, then as noted by Smoothy you file a law suit.
