A complaint has to be filed with the Texas Workforce Commission which operates like a labor board. Welcome to the Texas Workforce Commission
Also can you give any more info as to the type of violation, how you are aware of it.
It's the co. that my wife works for. It's a payroll issue. I found the code(chapter 61) at the TWC. What a piece of crap web site, anyway I finally found the form to fill out. The wife said ntd anything, because she's afraid that he will fire her.
You still haven't elaborated on what the issue is - and your wife is right. If you complain, she probably will get fired. That's why it's important to give us the full situation before we advise you to do/not do anything.Quote:

Hello h:
Look. I HATE lying bosses... But, if she complains, or SUES him, she'll lose her job... As long as she's at least getting paid, even if it's late, and if you guys can handle it, and if jobs are scarce in your town, I wouldn't do anything - at least to him. I certainly WOULD be looking for other work.

Sooo... is she behind in pay? As in, he owes her money for hours worked? Or is she just getting the check late, but still getting paid for her time?Quote:

Technically, the date is not a legal part of the check. So even if it's post-dated, your wife could still cash it. It might bounce, but she could still try.
The code states that a company must name a day as payday. He has 30 employees and all but 3 of them get paid every Friday. The other 3 have to beg for their checks the next week. My wife is 63, she can't just go out and get another job.
Is she on site working on the pay day?
Yes, it is wrong, I wonder if he is trying to make them quit for some reason.
But yes, far too often you complain, and of course they can't fire you for reporting them, but they find a dozen other reasons to do it.
Yes she is. They all use to get paid on Friday. 4 ladies work in the office. 3 of them over 50 get paid whenever. The 36 year old gets paid on Friday still... as always.Owner told 1 of the ladies he paid the 36 year old on Friday because she has kids
I have a question for you, heavyd40. What do you expect to get out of this? To be frank, everyone here has more or less told you that if you go ahead with filing a complaint, there's a pretty darn good job your wife will lose her job. You've already stated she's 63 years old and it will be hard for her to find another one.
So what's worth more to you: her bringing home a paycheck(even if it's late) or filing the complaint?
