    In diversion program while taking a background check for school clinicals! HELP
    I was arrested in Oct 2010 for theft in hamilton county, Ohio. When I went to court I was referred to the Diversion Program in Hamilton County... I was then accepted into diversion, I have to do 60 hours of community service and attend a 6 hour theft class, and pay a fine. I have to complete all of this within 6 months... well I finished it all in less than 30 days (one of the diversion workers told me that as soon as I was done that it would be erased/sealed... well when I went in today to turn my stuff in I seen that same lady that told me that and she stopped me and said that she would never say anything like that!) I am not stupid I know what she said! She deliberately lied to me and then told me that it would be in my best interest to not say that she said that to my real caseworker because they would never believe me! That right there threw a red flag to her! Anyway I thought that if I was able to finish early that would help because I have to do a background check for school and I am not sure what is going to show up. I had to do both the FBI check and the BCI checks, I am really scared that theft is going to show up and since I have been waiting 3 years to get into my school program, I am very scared... I was told both by a lawyer and my diversion caseworker that I am not, nor will I ever be convicted of this crime! And they will also send a letter of recommendation stating that I am not convicted! Should I be worried? Under disposition on my case it says diversion granted. Is anything going to show up? Please help me, I did my background check today... I am going into ultrasound, if that helps any! [/I] [/B]

    Yes it is very possible that it may show up. You are basically pleading guilty to be given a diversion program, then when you finish, the record is explunged, ( if there was not a record, it would not have to be explunged)

    I will be blunt, if you were waiting for three years for this, and it was that important, how come you stole something, you made a choice.

    But yes it is very possiible at this point it will show up

    Yes I understand, but the school is only looking for convictions... have I been convicted?

    I don't think it will show up, but that is my guess, Since it is not yet sealed.

    It was a pair of shoes that I did scan they just didn't take on the sales receipt... I talked to my lawyer and he said that diversion is the best way to go since I will never be convicted of the crime, he said it is the cheapest, easiest, fastest way without a conviction! Believe me I never wanted any of this!

    Also is explunged the same as sealed?

    Please do not use the comment feature to give info, please use the "answer" to add more info.

    Explunged means it is "done" away with, and is slightly different, but the issue with sealed and explunged is that unless it is a Juv record, they are always available to be seen by law enforcement and for national security backgrounds.

    Also if a company uses a private research firm, not the police records directly, if they found from their research this, they are not required to seal it.

    Okay, but if u are never convicted does it hurt getting into school or getting a job?
