My Husband and I got custody of his 2 kids from a prior relationship a yr ago. The girl and my husband were not married but living together, one day he came homeand she had taken the kids and left with all their belongings. He searched for them but couldn't find them. Five years later we get a call from cps 3 counties away asking if he had two children, come to find out, the girl had 3 kids and one on the way the third kid tested positive for meth at birth, and the state took that kid, she began getting visits with him and after several visits the child tested pos. again so they took all 3 kids. My husband and I went to court and won custody and we were ordered to give her visitation. She had her 4th child and two mnths later she was busted for a meth lab and the 4 kid was taken. When our kids go on visits w/her they come back and say inappropriate things, wearing the same clothes, haven't brushed their teeth hair is literally matted. She has no working seat belts in her car and no brakes, is living from house to house. Kids complain they have no heat at their moms nothing to eat or drink. They say other people at their moms are drunk when they go there. Recently over xmas break the kids spent 8 days w/their mom, they came home and said they had one bath the whole time they were there didn't brush teeth and my step daughteres hair was all matted and tangled. I am fed up, is this neglect and could we get in trouble for not allowing her to pick them up any more? She doesn't pay child support, or buy them anything, they both had a birthday in Nov. she didn't come to their party or get them anything not even a card. Please Im trying to raise these kids right and I hate knowing they are not being taken care of when on visits with her.

Yes, As long as a court order exists you have to obey it. That means you need to go to court to change things.

So are my claims reason enough for the courts to make a change in the visitation order, I mean could I have a chance, would they change it?

Go and get it changed to supervised visits till the mother proves fit. Take the pictures with you that you have been taking and request a change.

Yes, you have to honor the current court order, and we can not tell you what a judge will rule, for example a women who was a hooker, took men into the home where the kids were, drunk all the time, keep winning custody, time , after time, after time, but then in another court with another judge, they would not have

But no heat, bad living conditions, no seat belts, shojld be enough to do it, you could chck with your attorney, you may even be able to refuse to allow them in a car without seat belts

If the car has no Brakes or seatbelts you do not have to let them in the car until the vehicle is safe. If you need to phone the police about the unsafe car. Get in touch with a lawyer, maybe you can get an emergancy hearing. I'm surprised with the meth charges and the fact she is still using drugs the Judge allowed her Visitation at all.

I'm not surprised she was allowed visitation, but I am surprised it wasn't supervised. The previous poster does make a good point. Most states have laws about putting children in safety restraints in a car. So I think you can refuse to allow them to get into a car not properly equipped. As for the brakes issue though, not sure how you can no that the car doesn't have any or even low brakes.

Here on the family law board, we get TWO kinds of complaints... REAL ones, and made up ones because somebody is really pissed off. It's difficult to give good advice when you don't quite know which one you're dealing with... So, before we give advice, we look for clues.

You had me till you mentioned no brakes... Kids don't know about brakes.. A judge gave you custody because of her behavior, but didn't order SUPERVISED visits?? Meth lab and she's STILL on the street?? Nahh... I ain't buying it.
