The driver can sue you for any damage to his car that you dog did.
he could be ticketed for leaving the scene of an accident, dependent upon the amount of damage to his car and the value of your dog ( then depending on state law)
Not sure what your question is
Fr Chuck is right. My dog was hit a few years back. He was on a leash and we walking down a highway, and the driver honked her horn before passing us, my dog freaked out and backed out of the collar as the driver passed hitting him head on going about 80kmh. Max lived, be we were responsible for not only the vet bills, but the repair bills to the vehicle.
I also am not sure of the question, but I sure hope your dog is okay. That's why it is so important to always have your pets on leashes while in public places.
In my State (NY) a driver who strikes a domestic animal MUST report the accident to the Police. The driver is also required to stop at the scene.
As far as liability for damages - I'm a liability investigator and I'm sure it varies by State BUT the driver of the car has a responsibility to attempt to avoid the accident. I have not seen a pet owner 100% liable for damages to the car in years. A lot depends on the circumstances and whether the dog entered the roadway from the driver's right or left, in front, from the side.
