    Can separated spouse legally stalk spouse?
    My oldest daughter is being stalked by my so to be ex son in law (seriously). They have one child together and he has made her life a living hell. He follows her EVERYWHERE and if he doesn't like what she does or says, he gets loud/agressive/offensive/etc. He told her that if she moves back in with him, he will stop everything he is doing. Can he really LEGALLY stalk her like that?

    Of course, he can't. She must keep a log of when-where-what, and if she is afraid of him, she should contact the police.

    No he can't legally stalk her or harrass her. Get evidence together, verified documentation and get a restraining order against him. With this in place, if he tries to bother her, she calls the police and they take him in,

    I have to agree with the other answerers -- why would you think that your ex-son in law would have some special privilege to threaten/harass/stalk et al. your daughter?

    You (or rather, your daughter) must decide if she's going to accept his controlling and illegal behavior, or if she's not. If she doesn't accept, she needs to contact police and file a police report. The police officer can very likely advise you on the next general steps you might want to take.

    Several things, has she filed for divorce already ?

    Has she filed a police report about being harassed, and his distrubing the police. If he is bothering her somewhere, she calls the police, get a report every time it happens, after a few documented cases, she gets a restraining or protective order against him.

    He got a restraining order against HER on Dec 17th. He did not tell her about it until this past Sat when he picked up their daughter. He made all sorts of outlandish accusations against her. I told her that when they go to court Jan 6th,

    He had to prove everything he has claimed. Is that correct? He also gained temp. custody during the same court proceedings baised on the claims he made. Do you think this will end when they go back to court and he cannot prove anything?

    They are going to court Jan 6th for the divorce and custody hearing. I have personally seen him physically/emotionally abuse her as has her stepdad and her father and his wife. I told her what everyone on here suggested. She went to the police

    Station that day and made her statement. The police officer who took the information gave her his card and told her to call him if anything else happens.

    Look, at this point you know two things for sure: (1) based on what you've told me, this man is a sociopath and is playing hardball and is clearly a danger to not only your daughter but to you and any children and/or other family members involved. (2) you absolutely MUST have the assistance of a local attorney.

    This guy has made it clear that he will stop at nothing until he is stopped, including lying to the court to obtain a temporary restraining order against your daughter, based on what you told me, by lying or perjuring himself. That alone may be a felony.

    You don't have a choice. Take out a loan, borrow from relatives, but do whatever you have to do and HIRE AN ATTORNEY to sort out this mess, and do it before any future court hearings.

    This forum CANNOT HELP YOU any more. You must get a lawyer. Based on what you've told me I believe that YOU ARE IN DANGER.

    He filed the divorce during the same proceedings as the temp custody. She filed the report the day it was suggested to me. I called her and told her about it and she went did it not long after I told her about it.

    He is a convicted felon so I don't think he cares too much about lying or not. There is NO way I can get the money for her nor can she get the money to get an attorney. He told her that if she comes back to him, he will drop everything and give her

    Back her daughter.
