Ask Me Help Desk - Full custody of an illigitimate child for travel purposes

I am applying for a visa for my 3 yrs old son, illigitimate but carrying his father's name, to join me here in France, and they asked me to get a FULL CUSTODY. So, I asked my mother who is taking care of my son, to take this document at a reginal trial court. And this is what happened, the father,who abandoned and never gave any support disposed an AFFIDAVIT OF FULL CUSTODY which is signed in front of a lawyer and was afterward, certified by a judge. It comes in 2 pages, the AFFIDAVIT OF FULL CUSTODY sign by the father and a lawyer and the second page, CERTIFICATE OF AUTHORITY FOR A NOTARIAL ACT which states that, the judge certified “that the attorney who signed the AFFIDAVIT OF FULL CUSTODY entered his notarial regsiter as doc …….”

But the reeve that is incharge of the papers rejected the document. He said he needs a Real full custody, the one that the judge himself gave the full custody of my child to me.

How can I obtain this? Don't know else what to do. *** I need someone to help me. What exactly is a FULL CUSTODY? I have a feeling that the judge and the lawyer gave me a wrong document at very high price.

I am very confused at this point, but I'm going to take a guess at this:

You had an illegitimate child with a man, and gave the baby his last name. You chose to travel to France and were unable to obtain a passport for the child without the father's consent. In order to obtain the passport, you were told to obtain "full custody" which is the legal right to make decisions for the child.

I don't know what "document" the judge gave you or why you were charged for said document.

Where are you located? Where was the child born? Where is your citizenship and where is your child's citizenship?

Yes, the father gave his last name to my son who is now 3yrs old. The father never gave any support (in addition, he asked money on every paper he sign for this travel, affidavits e.g.. ) and is now married and have his own family. My son is in the care of my mother in the Philippines since I left.

I am in France for about 2 yrs now. I am a natural born Filipina and now also married to a French national.

We already obtained the passport for my son. But now, to begin the request of visa here in France, they are asking me to produce a document called FULL CUSTODY (so my son can live with me here in france). That a juge is giving me all the right to my child and nothing for the father even my child is carrying his last name.

I want to know what exactly is written in a document called FULL CUSTODY because for the chief-in-charge, what I sent him was not he is asking for.

This is what a judge in the Philippines gave my mother and what afterwards, was sent here in France to the chief-incharge of the visa..

They rejected this document and were asking me to produce something that the judge himself is giving me the cusotdy. But according to the judge, it is this what they are asking and nothing else, and she already made this type of document many times before.

What should I do?
