    Ex Husband drama please help!
    I was divorced in California. My ex got the house - however he was unable to refinance. My lawyer put a clause in the divorce that I am not liable for anything after the divorce. Well the mortgage company doesn't see it that way. They are holding me liable as a co-signer on the mortgage. My ex refuses to sell the property. I have taken him to court and got a $ settlement - however now he is filing bankruptcy. Am I immediately looked at as a creditor? Will his trustee listen to my appeal if I talk to them. How do I find out who his trustee is. I believe he has filed chapter 13.

    Yeah, it's a problem. Your contract with the mortgage company supercedes any agreement you have with your ex and the lawyers. Until the original mortgage is paid off it will still appear to be yours as well as his. As long as your name is on the original mortgage, it's still yours. Appeal all you want, but the mortgage company has the final say so. And since you co-signed, you will appear on the mortgage until it's paid off. I know it's crap, but that is what you have to look forward to.
