    I mean I call my one son "Bo" and another "JR" not their real names.

    And a person may use a false name or fake name if they want ( no law against it) unless they are doing it for a criminal reason

    She claims that it is what the kids want, however they are 13 and 10. The way I look at it is that the kids should not be ashamed of who they are, regardless of what they have been told by whoever. And she should be adult enough to explain


    That there are legal avenues that must be taken(like adoption) in order to legally change their names.

    I realize full well that a legal name change must be done through the courts; that's not what I asked you. I asked if you could provide us with more insight as to what it is you're inquiring about. Can you please stop using these generic terms such as "She should be adult enough to explain"?

    Who are you in this situation? Whose children are we discussing? What is it that you think needs to be explained to the children? What name are the children using? Why is this such a great concern to you?

    Your responses are not answering the questions here. A person can use ANY name they want as long as there is no intent to defraud. So, if a child wants to use a different name on a club roster, there is nothing illegal about it.

    On the other hand, a person cannot cash or deposit a check made out to a name other than their legal name.

    The using a different name is a funny thing, there are almost no laws that stop it, unless you are doing it to do a criminal act. Or to lie to the police.

    Criminals give false names when they are arrested, and their finger prints prove them wrong, they are seldom charged for that false info.

    You can open a checking acount in another name if the bank would allow you, ( it is hard now due to proof of ID that is required for a bank)

    But if the kids want to, there is really nothing to stop them.

    My assumption is that the mother of the children is allowing them to use her maiden name as their surname. Or, there was an issue with paternity and the children are using one surname instead of the other. Whoever this person is feels the children should be using one name instead of the other.

    It's impossible to tell, as the questions are still unanswered. But that's my guess.
