I divorced my ex husband years ago and I'm now in a relationship with another man. My sons biological father is suppose to supply the insurance for our son but he is not doing so because he is not employed. In order for me and my now husband to put my son on his insurance through his employer he has to be a guardian of my son. Can I some how allow my now husband to have guardianship over my son with out telling my ex husband?

If your ex-husband has custody and visitation rights, you are most likely not going to be able to let your husband obtain guardianship without the father's consent.

Have you spoken to your ex about this and asked what his opposition would be to allowing your husband to have guardianship?
