    DUI probation interlock violation
    First Ill say what I did was incredibly stupid...

    Saturday night I drank a 12 pack at home, and Sunday morning at 11 I had an interview for a new job. I tried to start my interlock 3 times and failed and results in a violation reset. Wednesday morning I have to go to the Interlock garage and they will report the violation to my probation officer.

    Ive had interlock on my car for 6 months and its set to be taken out on 1/29/07. Ive had no other violations on interlock, no drug test violations, no tickets for 2 my 2 year probation period and I'm set to be off probation mid April. This is Ohio also..

    Has this happened to anyone here before that might know:
    Will this automatically go before the judge ?
    Does my prob officer have the discretion to deal with this on her own?

    Im planning on calling her tomorrow and letting her know about this before she finds out about it in a report..

    And am I going to go to jail for this violation?

    Sunday morning for a job interview, just seems like a funny time for it.

    It will be completely up to the probation officer as to if they want to violate you, if they do, then up to the judge what will happen.

    My guess, and it is only a guess, it may let it slide, but really can't tell

    I just got called in by my Probation Officer for the same thing. I literally swigged Listerine before having someone ELSE drive my car for me and it failed. We had to leave to get where we were going ontime and I couldn't give it a follow-up blow. I have a frigging court date scheduled now to try and NOT allow this PO to violate my probation. My lawyer is scheduling me to take a poly-graph test so I can attempt to prove that I was NOT rinking (which I wasn't). And get this: I blew a .112 from the Inter-Lock JUST from swishing listerine a few minutes before. That looks really, really bad and I think I'm going to get in big trouble for this with Mason, OH. They are being really strict about everything. I wasn't drinking! OMG. They're never going to believe me.

    I thought the results of polygraph testing (lie detector tests) are NOT admissible in Court in Ohio so I am confused that your Attorney is recommending that you take the test.

    Did your Attorney say he is submitting the results to the Court OR that the test is being done for his/her (the Attorney's) peace of mind?
