    Form 1040NR or 1040NR-EZ is filed by nonresidents. Form 1040-EZ, 1040A or 1040 is filed by residents.
    If you are an F-1 student, you are nonresident for 5-years.

    Forms 1040NR and 1040NR-EZ must be mailed; electronic filing is not permitted. Further, you probably will also have to file Form 8843 with the Form 1040NR or 1040NR-EZ.

    You can file the return ANYTIME after 1 January of the following year.

    However, you only have THREE years after the initial filing deadline to claim a refund.

    Example:

    For 2007, the initial filing deadline is 15 April 2008. That means you have until 15 April 2011 to file the 2007 returns (Form 1040NR or 1040NR-EZ) and claim any refund due to the three year statute of limitation.

    This means that, though you could file the 2006 Form 1040NR, you would NOT get any refund.

    Yes, you can file the Tax Year 2009 Form 1040NR or Form 1040NR-EZ in December 2010.

    The REAL deadline to file is 15 April 2013. If you file after that date, you forfeit any refund due.
