    I'm marvz, 21 y/o.My ex-girlfriend will give birth next jan. 2011, and she doesn't want me to be there at that moment. And she doesn't want the baby to carry my surname. I insist that our baby should carry my surname, but she said that she should be the one to decide to what surname the baby must carry. Do I have the right to let my baby carry my surname? Please help, just want to be a responsible father for my son.

    If you're not married it's her choice to give her surname to the child.

    She is you EX-girlfriend. Altenweg is right: you don't really have the right to insist on the name of a child whose mother you have no marital (or even romantic) relations with anymore. She also can insist that you're not at the delivery. However, I'm pretty sure you have the right to spend time with your son after the birth - talk that out with your ex.

    Legally you have no right to give the baby your surname as you are not married. Also, she has every right from preventing you in the delivery room.

    She can even sign into the hospital with the stipulation that none of the nurses are allowed to ascknowledge to outside parties that she is even a patient there.

    You will have no rights till the child is born and you file and go to court to establish rights to visit with the child
