Should my husband still pay child support when my 10 yr old step-son lives with us full time? She currently is sharing a room with him and staying with a friend because she is unable to provide for him. She is the custodial parent and my husband is the noncustodial parent. They were never married. They agreed in court when he was 2 yrs old. She would have primary custody and they would share legal custody and his father would pay X amount a week in child support.

He is required to pay child support until he goes back to court and get the custody and the child support orders changed.

It doesn't sound right that he's paying, that's for sure, but the only way he can get it changed is for him to go back to court.

Child support for is for raising the child, not supporting an ex-girlfriend.

I'd suggest getting an attorney ASAP and file for permanent custody of the step-son and ask for her to return the payments he paid while his son was living with you.
