Can I sue my son's father for child support by filing voluntary impovershment?
My son's father has not paid child support since march 2009, claiming that he is temporarily disabled due to an incident that occurred during a ski trip. He pulled a muscle in his knee and is now claiming that he cannot work. Now as of August 2010, he is claiming to be permanently disabled and cannot work and advising that he was fired from his state job with the city due to the injury. However, he has not shown proof that he was terminated and did not quit. He has yet to claim for unemployment benefits or social security disability. Per his doctor note that he showed the court from march 2009, claims that he needs to lose 50 pds to take pressure off knee and they would like him to come back for an evaluation at a later date. However, he has not attempted to file for any non-sedentary employment and the court dates keep being rescheduled to give him time to find work which he has yet to show proof that he is doing this. I feel that the court is not really helping and I need to see what other avenues I can take.
