    What is the Statue of Limitations in ontario on a criminal charge?
    I was charged in late Dec. 2007 with a criminal offence (three years ago!). To date, I am still waiting for a trial date. Is there a statue of limitations in Ontario?

    For what crime? Certain crimes have no statute of limitations.

    Incidentally the statute of limitations is between the commission of the act and you being charged... when you are charged the clock stops running.

    Hello t:

    Here in this country, the statute runs from the time the crime is discovered until someone is charged or it runs out. You were charged, so the SOL doesn't apply. We also have a quick and speedy trial provision that I don't think Canada has..

    Most defense lawyers think a long time between the offense and a trial is a GOOD thing.
