    What are the laws in VA to protect newborns from an unmarried couple? Can one of the parents take the child as wish out of state or out of country?

    Hello father:

    Both parents have equal rights to the children... If you want to establish your rights in COURT, you need to file IMMEDIATELY after the child is born... Had you done that, she couldn't have left the state WITHOUT your permission.

    Instead of asking a general question we can help better if you tell us what has happened. Are you the father or mother? Are listed on the birth certificate or signed an acknowledgment of paternity. Has the mother left the state yet or are you just worried about it?

    VA law will not allow the mother to leave without court permission if there is court ordered visitation and custody. However, if she does, it may be difficult to get her back. If there is pending litigation she could be enjoined from leaving until its been settled.

    Are both listed on the birth certificate ? That is the first issue,

    Is there any court ordered custody papers ?

    If both are listed on the birth certificate and there is no court ordered custody, either has equal rights to the child.
