    Employer/Garnishee questions the employee's approval
    I read in a recent post that before I take out 25% of an employees wage, that employee must approve this in writing. Is this true in Florida? If I must hire an attorney for this answer it will just increase my employees debt.

    Hello r:

    You have a court order directing you to do thus and so. You do NOT need the defendants PERMISSION before you execute the order.

    Court orders supercede anything that the garnishee has to say about it. You are essentially GIVEN permission and ORDERED to take the money out of their paycheck by the Judge. If you didn't take the money out as Ordered the Judge will ask you at a hearing just what your excuse/reason is. I don't think you want that to go that far.
